The son of the late Eric Garner was arrested for allegedly stealing a Citi Bike on Tuesday evening, The New York Daily News reports.

Emery Snipes was stopped by NYPD officers for riding the bike against traffic and entering a park after dark in lower Manhattan. The 16-year-old was then unable to provide officers with a receipt for the rented bike. Citi Bike is a sharing system that allows residents to ride bicycles throughout the city and surrounding boroughs.

Snipes was issued two summons: one for riding the bike against traffic, and the other for being present in a city park after dusk. He was also given one day of community service. A judge informed the teen he could avoid charges if he stays out of trouble for six months.

Snipes’ father was killed by a police officer in July 2014 after being placed in an illegal chokehold. Protests and outcry spread throughout the nation after the incident was recorded on a pedestrian’s cell phone. Charges were not brought against the officer involved.

Snipes’ mother, Esaw Garner, said her son has been grounded and lost his phone privileges. However, she also said Emery was unaware of the park rules and didn’t know the bike was stolen.

The New York Daily News reports:

“My son is not a thief,” she said. “He just happened to be with his friends. He did not know that the Citibike had been taken. He didn’t know that he couldn’t be in the park after dark,” she said. “But right now, he’s not going out at all. He’s definitely grounded.

The family was recently awarded $5.9 million in a settlement with the NYPD following Garner’s death.
